General Terms and Conditions (GTC)
The Gentlemen’s Company Germany GmbH
1. SCOPE
This website, operated by The Gentlemen's Company Germany GmbH, is exclusively aimed at consumers. These GTC apply to all orders placed through our online store. A consumer is any natural person who concludes a legal transaction for private purposes. Entrepreneurs act within the scope of their commercial or independent professional activities.
2. CONTRACTUAL PARTNER AND CONCLUSION OF CONTRACT
The purchase contract is concluded with The Gentlemen's Company Germany GmbH. The product presentation in the online store represents a non-binding online catalog. Products can be placed in the shopping cart without obligation. A binding order is placed by clicking the “Buy” button at the end of the ordering process. Confirmation of receipt of the order is sent by email immediately after submission.
3. CONTRACT LANGUAGE AND STORAGE OF CONTRACT
The contract language is German or English. The contract text is stored by us and we send you both the order data and our GTC in text form. For security reasons, the contract text is no longer accessible over the Internet.
4. DELIVERY CONDITIONS
We offer global delivery and ship our products worldwide.
Standard shipping within Germany, Austria, and Switzerland is free of charge. For global shipping, shipping costs may vary depending on the destination and will be listed separately in the shopping cart before completing the order.
Our ZenRush Premium Shipping is only available for delivery addresses in Germany. For orders below a goods value of 85 EUR, additional fees apply for ZenRush Premium Shipping, which are displayed in the shopping cart.
Delivery of the order is exclusively via shipping. If the buyer provides an incorrect address, resulting in the need for reshipment, we reserve the right to charge a shipping fee of 5.99 EUR subsequently. It is the buyer's responsibility to check all address and contact details for accuracy before completing the order process.
In the event of non-delivery or refusal to accept delivery for reasons not attributable to us, we will assume that the buyer has withdrawn from the contract. In such a case, our return policy, which is listed separately, applies.
5. PAYMENT METHODS
5.1 Shopify Payments
Various payment methods are available in our online store.
When choosing a payment method offered via the "Shopify Payments" service, such as credit card, SOFORT by Klarna, Klarna invoice purchase, and UnionPay, payment processing is carried out by the payment service provider Shopify International Limited, 2nd Floor Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter referred to as “Shopify”). The respective payment methods offered via Shopify are displayed in the online store. Shopify may use other payment services, for which special payment conditions may apply, about which you will be informed separately. 5.2 Other Payment Methods
Amazon Pay: This payment method allows you to use the payment information and addresses stored with Amazon. You will be redirected to the Amazon website before completing the order process to confirm the payment instruction. The payment transaction is automatically carried out by Amazon. Further instructions are provided during the order process. The guidelines and terms of use of Amazon Pay apply to payments made via Amazon Pay.
PayPal, PayPal Express: When choosing PayPal as the payment method, you will be redirected to the PayPal website. After logging in or creating a new account, you confirm the payment instruction. The payment transaction is carried out immediately afterward by PayPal. The terms and conditions of PayPal apply when using PayPal as the payment method.
6. RETENTION OF TITLE
The goods remain the property of The Gentlemen’s Company Germany GmbH until full payment is received.
7. TRANSPORT DAMAGES
In case of delivery with obvious transport damages, these should be claimed with the carrier and reported to us immediately. Failure to make a complaint has no consequences for your statutory rights. By making a complaint, you assist us in asserting our claims against the shipping service provider.
8. WARRANTY AND GUARANTEES
8.1 General Provisions
Unless otherwise stipulated in the following regulations, the provisions of statutory warranty liability apply. Information on any additional guarantees can be found on the product page and designated information pages in the shop, particularly the Gentlemen’s Help Center.
8.2 Warranty Provisions for Orders from Switzerland
Special warranty provisions apply to customers in Switzerland.
We provide a warranty for the absence of defects and functionality of the goods for 2 years after delivery. We can optionally provide the warranty by the following measures:
- Repair, whereby the original warranty period continues after subsequent performance.
- Partial or full replacement with an equivalent product. In the case of replacement, the original warranty period continues.
- Reduction of the purchase price, or
- Full credit.
Wear parts are excluded from the warranty. All further and, in particular, the statutory provisions on warranty are excluded.
9. RIGHT OF WITHDRAWAL
The statutory right of withdrawal applies unequivocally to both parties and is valid for 14 days from the date of delivery. Details on the right of withdrawal can be found in our return policy.
10. LIABILITY
We are liable without limitation for intent, gross negligence, injury to life, body, or health, and under the German Product Liability Act (ProdHaftG). In the case of slight negligence, liability is limited to foreseeable damages.
11. DISPUTE RESOLUTION
The European Commission provides a platform for online dispute resolution. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
12. FINAL PROVISIONS
